Deputies from “United Russia” in the Duma introduced a bill that increases four times, up to one year Statute of limitations on administrative cases of violation of the order of NGOs “imagenow”, and transmits the consideration of these cases at a higher level.
The authors indicate that the limitation period for liability for violation of the order of the work of NGOs – a “foreign agent” is three months (article 4.5 of the Federal Code of administrative offences).
Practice shows that taking into account the specifics of the offence, this period is insufficient: these things require expert research, and it takes a lot of time writing parliamentarians and offer to increase the Statute of limitations to one year.
“Analysis of judicial practice also shows that submitted by the magistrates regulations may have changed the higher judiciary from the incorrect application of the law. Based on the above, the draft Federal law proposes to amend part 3 of article 23.1 of the code of administrative offences of the Russian Federation, and excluding from the jurisdiction of the magistrates and referring to the jurisdiction of district judges,” reads the explanatory note to the bill.
Justices of the peace usually consider small and simple things, the more complex are sent to the district courts.
The authors of the bill – the head of the constitutional Committee of the state Duma Vladimir Pligin and a member of the same Committee Vladimir Ponevejsky (both EP).
In November 2012, the law obliged funded from abroad political NGOs to register as “foreign agents.” Now in the list of about 40 organizations. Parliament is a bill providing for a mechanism of exclusion of NGOs from the list of imagenow” until now it was impossible.
